Can Foreigners Buy Property in Azerbaijan? Residency Guide

Yes. Foreigners can buy apartments, houses and other buildings in Azerbaijan, but they cannot own land. Owning real estate worth at least 100,000 AZN gives you the right to apply for a temporary residence permit. Property worth 200,000 AZN or more opens the way to a permanent permit after two years on a temporary one. What a foreigner can and cannot buy

Foreign nationals and stateless persons in Azerbaijan can own residential and non-residential buildings, such as apartments, houses and offices. No prior permission, residency or local company is required. The rules apply equally to every foreign national; there are no separate conditions by country.

The restriction concerns land. A foreigner cannot own a plot, but can hold it on a long-term lease. When you buy an apartment in a residential building, this makes no practical difference, because you own the apartment itself outright. How the purchase works

The process is the same as for a local buyer:

1. Choose the home and check the documents (registry extract, encumbrances).
2. Have your passport translated into Azerbaijani and notarised.
3. Sign the sale contract before a notary, in person or through a power of attorney.
4. Register ownership in the state register and receive the extract.

Residency through property: 100,000 and 200,000 AZN

Azerbaijan has no separately branded "golden visa". Instead, property ownership is one of the standard grounds for a residence permit. According to the State Migration Service:

• Temporary residence permit: a foreigner who owns real estate in Azerbaijan worth at least 100,000 AZN may apply.
• Permanent residence permit: a foreigner who owns real estate worth at least 200,000 AZN, and has lived in the country for at least two years on a temporary permit, may apply.

These thresholds apply since the 2023 amendments to the Migration Code. A temporary permit is issued for a limited term and can be renewed while you keep the property.

The conditions that matter

This is where most people go wrong:

• It is not automatic. Ownership is a ground to apply; the State Migration Service makes the decision.
• The property must be registered. The application includes the extract confirming state registration of ownership, and the property must be in the applicant's name.
• Off-plan does not count yet. A developer contract does not replace the extract. The right arises once the building is commissioned and your ownership is registered.
• The value must be evidenced. Value is confirmed by a valuation or official documents; the contract price alone may not be enough.
• Family members. A spouse and minor children can apply on the basis of their family relationship.

Where and how to apply

Applications go to the State Migration Service, including through ASAN service centres. You will usually need your passport, the extract confirming registered ownership, a document evidencing the property's value, and proof of payment of the state fee. Mortgages and payment plans for foreigners

Bank mortgages for foreigners are limited, so most foreign buyers pay cash or use a developer instalment plan. With an instalment plan, confirm in the contract when ownership will be registered in your name: for residency, that is the date that matters. Buying remotely
